Please read these terms carefully before using CodePulse. By using our service, you agree to be bound by these terms.

Acceptance of Terms

By accessing or using CodePulse ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and CodePulse. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

By connecting your GitHub account to CodePulse, you acknowledge that you have read, understood, and agree to these Terms.

Service Description

CodePulse is an engineering analytics platform that provides:

- DORA Metrics Tracking: Deployment frequency, lead time for changes, change failure rate, and mean time to recovery - Cycle Time Analysis: Track how long code takes from first commit to production - Team Velocity Metrics: Measure and compare team throughput over time - Code Review Analytics: Understand review patterns, bottlenecks, and coverage - Knowledge Silo Detection: Identify single points of failure in your codebase - Developer Leaderboards: Recognize high performers and identify growth opportunities

The Service integrates with GitHub via OAuth to collect repository metadata, pull request information, and commit data. We do not access or store your source code.

Account Responsibilities

Authentication: You authenticate with CodePulse using your GitHub account. You are responsible for maintaining the security of your GitHub credentials.

Accurate Information: You agree to provide accurate and complete information when creating your account and to keep this information current.

Account Security: You are responsible for all activities that occur under your account. Notify us immediately at security@codepulsehq.com if you suspect unauthorized access.

Organizational Accounts: If you connect an organization's GitHub account, you represent that you have authority to do so and to grant CodePulse access to that organization's repository data.

One Account Per Person: Each user account should correspond to a single individual. Sharing account credentials is prohibited.

Acceptable Use

You agree NOT to:

Technical Abuse: - Attempt to reverse engineer, decompile, or disassemble the Service - Use automated scripts to access the Service except through our official API - Attempt to gain unauthorized access to any part of the Service - Interfere with or disrupt the Service or its infrastructure - Circumvent any rate limits or access controls

Data Abuse: - Use the Service to collect data for purposes other than your organization's internal analytics - Resell, redistribute, or publicly share data obtained from the Service - Use the Service to track, monitor, or surveil individuals without their knowledge

Harmful Activities: - Use the Service for any unlawful purpose - Violate any applicable laws or regulations - Infringe on the rights of others - Transmit malware or malicious code

Violation of these terms may result in immediate termination of your account.

Intellectual Property

Our Property: CodePulse, including its design, features, code, and documentation, is owned by CodePulse and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service.

Your Data: You retain all rights to your data. By using the Service, you grant CodePulse a limited license to process your data solely for the purpose of providing the Service.

Feedback: If you provide suggestions or feedback about the Service, you grant us the right to use that feedback without compensation or attribution.

Trademarks: CodePulse, the CodePulse logo, and related marks are trademarks of CodePulse. You may not use these marks without prior written permission.

Data & Privacy

Your privacy is important to us. Our use of your data is governed by our Privacy Policy.

Key Points: - We only collect repository metadata, not source code - Your data is encrypted at rest and in transit - We do not sell or share your data with third parties for marketing - You can export or delete your data at any time - We comply with GDPR and other applicable privacy regulations

Service Availability

Best Efforts: We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service is provided "as is" and "as available."

Planned Maintenance: We may temporarily suspend the Service for maintenance. When possible, we will provide advance notice of planned maintenance windows.

Modifications: We reserve the right to modify, suspend, or discontinue any part of the Service at any time. Material changes will be communicated in advance when feasible.

Third-Party Dependencies: The Service depends on GitHub's API. We are not responsible for outages or changes to GitHub's service that may affect CodePulse.

Limitation of Liability

Disclaimer of Warranties: THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Damages: TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODEPULSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Cap on Liability: OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Exceptions: Some jurisdictions do not allow certain limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

Termination

Termination by You: You may stop using the Service at any time. To fully terminate your account: 1. Revoke CodePulse's access in your GitHub settings 2. Request data deletion through the CodePulse dashboard or by contacting us

Termination by Us: We may suspend or terminate your access to the Service if: - You violate these Terms - Your use poses a security risk to the Service or other users - Required by law - We discontinue the Service

Effect of Termination: Upon termination: - Your access to the Service will be revoked - Your data will be deleted within 30 days (unless required by law to retain) - Provisions that should survive termination (such as limitation of liability) will remain in effect

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Dispute Resolution: Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of the United Kingdom.

Class Action Waiver: You agree to resolve any disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
